Divorce and Financial Proceedings

There is one ground for divorce, which is the irretrievable breakdown of the marriage. The assets of the marriage will be divided upon the parties getting divorced. It is advised that you should amicably agree the division of the marital assets and the financial arrangements which are then embodied into a legal document by a solicitor. Only in the absence of such an agreement should you consider commencing financial proceedings.

Children Arrangements

When the relationship comes to an end the parents will have to decide with whom the children should reside. Should a dispute arise then you can commence children proceedings and the Court will then decide with whom the children should reside. The non-resident parent will have scheduled contact with the children.

Other Children Orders will include a Prohibited Steps Order, which prevents one parent from taking the children out of the jurisdiction. A Specific Issue Order can be obtained where parents cannot decide on a particular matter concerning the children.

Agreements

Cohabitation Agreements
This is when an unmarried couple in a relationship, live together. A couple who have cohabited will not be protected with the same rights as a married couple and therefore all cohabitees are advised to have a Cohabitation Agreement to protect them financially.

Pre-Nuptial and Post-Nuptial Agreements
A Pre-Nuptial agreement is made between a couple people before they get married. A Post-Nuptial agreement is made after the parties have been married. Both types of agreements include the division of assets in the event that the parties get divorced. These agreements are not currently binding in England and Wales.

Separation Agreements
This is an agreement between parties whether they have been married or cohabiting, dividing the financial assets in the relationship upon separation.

Domestic violence is commonly associated with physical violence. There are many forms of domestic violence which include sexual abuse, mental and emotional abuse. Court proceedings would involve obtaining a Non-Molestation Order to restrain the perpetrator from contacting the victim being subjected to the violent behaviour.
